These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and Totem ("Totem", "we", "us"), the developer and publisher of the Antheartide mobile application ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not install or use the App.
The App is a general-wellness and research tool. It is not a medical device as defined by the U.S. Food and Drug Administration (FDA), the European Union Medical Device Regulation (EU MDR 2017/745), or any equivalent regulatory body. The App has not been reviewed, cleared, or approved by any regulatory authority.
Information provided by the App — including heart rate, ECG waveforms, and heart rate variability metrics — is for personal reference only and must not be used for medical diagnosis, treatment, or decision-making. Always seek the advice of a qualified healthcare professional for any medical concern.
The App is not intended for use in medical emergencies. If you believe you are experiencing a medical emergency, call your local emergency number (e.g. 112, 911, 118) or go to the nearest emergency room.
The App is designed to interoperate with external sensors manufactured by third parties (including standard Bluetooth Low Energy heart-rate chest straps and Apple Watch). The regulatory status of those sensors varies by jurisdiction and is the sole responsibility of their respective manufacturers. Use the App only with hardware that is lawfully available in your jurisdiction. Totem makes no representation or warranty as to the accuracy, reliability, or clinical validity of data acquired through third-party hardware.
Subject to your compliance with these Terms, Totem grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use, in accordance with the usage rules set forth in Apple Media Services Terms of Service.
The App offers optional in-app purchases, including non-consumable unlocks and auto-renewable subscriptions:
Payment will be charged to your Apple ID account at the confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage your subscriptions and turn off auto-renewal in your App Store account settings. No cancellation of the current subscription is allowed during the active subscription period. Unused portions of a free trial period, if offered, will be forfeited when you purchase a subscription.
Prices are shown in the App in your local currency and may vary by country. Refunds are handled according to Apple's refund policy.

The App, its content, trademarks, designs, AI models, and all associated intellectual property are and remain the exclusive property of Totem and its licensors. These Terms do not grant you any right, title, or interest in the App other than the limited license described above.
Your use of the App is also governed by our Privacy Policy, which describes how data is collected, processed, and stored. All health and sensor data is processed locally on your device.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. TOTEM DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, NOR THAT ANY HEALTH-RELATED MEASUREMENT OR AI OUTPUT IS ACCURATE OR CLINICALLY VALID.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOTEM, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR HEALTH OUTCOMES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE APP; (B) ANY RELIANCE PLACED ON THE ACCURACY OR COMPLETENESS OF DATA DISPLAYED BY THE APP; OR (C) ANY DECISION MADE BASED ON INFORMATION OBTAINED FROM THE APP.
You agree to indemnify, defend, and hold harmless Totem and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App or your violation of these Terms.
Totem may modify these Terms at any time. Material changes will be announced in the App or on this page, and the "Last updated" date at the top of this document will be revised. Your continued use of the App after such changes constitutes acceptance of the updated Terms.
You may stop using the App at any time by uninstalling it. Totem may suspend or terminate your access to the App at any time, with or without notice, if you breach these Terms. Upon termination, the license granted in Section 4 ceases immediately.
The App may integrate with third-party services (Apple Health, Nostr relays, Apple Watch, BLE heart-rate accessories). Use of these services is subject to the terms and privacy policies of the respective third parties. Totem is not responsible for third-party services.
These Terms are concluded between you and Totem only, and not with Apple Inc. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you, if applicable. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict-of-laws rules. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Italy, except where mandatory consumer-protection laws require otherwise.
I presenti Termini d'Uso ("Termini") costituiscono un accordo giuridicamente vincolante tra te ("Utente" o "tu") e Totem ("Totem", "noi"), sviluppatore ed editore dell'applicazione mobile Antheartide ("l'App"). Scaricando, installando o utilizzando l'App accetti di essere vincolato dai presenti Termini. Se non accetti, non installare né utilizzare l'App.
L'App è uno strumento di benessere generale e ricerca. Non è un dispositivo medico ai sensi del Regolamento UE 2017/745 sui dispositivi medici (MDR), della Food and Drug Administration (FDA) statunitense, né di alcun organismo regolatorio equivalente. L'App non è stata esaminata, autorizzata o approvata da alcuna autorità regolatoria.
Le informazioni fornite dall'App — inclusi frequenza cardiaca, tracciati ECG e metriche di variabilità della frequenza cardiaca — sono esclusivamente a fini di riferimento personale e non devono essere utilizzate per diagnosi mediche, trattamenti o decisioni cliniche. Consulta sempre un professionista sanitario qualificato per qualsiasi questione medica.
L'App non è destinata all'uso in situazioni di emergenza medica. In caso di emergenza chiama il numero locale di soccorso (es. 112, 911, 118) o recati al pronto soccorso più vicino.
L'App è progettata per interoperare con sensori esterni prodotti da terzi (incluse fasce toraciche cardio Bluetooth Low Energy standard e Apple Watch). Lo stato regolatorio di tali sensori varia in base alla giurisdizione ed è di esclusiva responsabilità dei rispettivi produttori. Utilizza l'App esclusivamente con hardware legalmente disponibile nella tua giurisdizione. Totem non fornisce alcuna garanzia in merito all'accuratezza, affidabilità o validità clinica dei dati acquisiti tramite hardware di terzi.
Subordinatamente al rispetto dei presenti Termini, Totem ti concede una licenza limitata, non esclusiva, non trasferibile e revocabile per scaricare e utilizzare l'App su dispositivi Apple di tua proprietà o sotto il tuo controllo, esclusivamente per uso personale e non commerciale, conformemente alle Usage Rules previste dai Termini di Servizio di Apple Media Services.
L'App offre acquisti in-app facoltativi, inclusi sblocchi non-consumabili e abbonamenti auto-rinnovabili:
Il pagamento verrà addebitato al tuo account Apple ID alla conferma dell'acquisto. Gli abbonamenti si rinnovano automaticamente salvo cancellazione almeno 24 ore prima della scadenza del periodo in corso. L'addebito del rinnovo avverrà entro le 24 ore precedenti la scadenza del periodo in corso. Puoi gestire gli abbonamenti e disattivare il rinnovo automatico nelle impostazioni del tuo account App Store. Non è consentita la cancellazione dell'abbonamento in corso durante il periodo attivo. Le eventuali porzioni non utilizzate di un periodo di prova gratuito, se offerto, saranno perse all'acquisto di un abbonamento.
I prezzi sono mostrati nell'App nella tua valuta locale e possono variare a seconda del Paese. I rimborsi sono gestiti secondo la politica di rimborso di Apple.

L'App, i suoi contenuti, i marchi, il design, i modelli di intelligenza artificiale e tutta la proprietà intellettuale associata sono e restano di esclusiva proprietà di Totem e dei suoi licenzianti. I presenti Termini non ti conferiscono alcun diritto, titolo o interesse sull'App diverso dalla licenza limitata descritta sopra.
L'uso dell'App è disciplinato anche dalla nostra Privacy Policy, che descrive come i dati vengono raccolti, trattati e archiviati. Tutti i dati sanitari e dei sensori vengono elaborati localmente sul tuo dispositivo.
L'APP È FORNITA "COSÌ COM'È" E "COME DISPONIBILE", SENZA GARANZIE DI ALCUN TIPO, ESPRESSE O IMPLICITE, INCLUSE A TITOLO ESEMPLIFICATIVO LE GARANZIE IMPLICITE DI COMMERCIABILITÀ, IDONEITÀ A UNO SCOPO SPECIFICO, NON VIOLAZIONE O ACCURATEZZA DEI DATI. TOTEM NON GARANTISCE CHE L'APP SARÀ PRIVA DI INTERRUZIONI O ERRORI, NÉ CHE QUALSIASI MISURAZIONE SANITARIA O OUTPUT DI INTELLIGENZA ARTIFICIALE SIA ACCURATO O CLINICAMENTE VALIDATO.
NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE APPLICABILE, TOTEM, LE SUE AFFILIATE O I SUOI LICENZIANTI NON SARANNO IN ALCUN CASO RESPONSABILI DI DANNI INDIRETTI, INCIDENTALI, SPECIALI, CONSEQUENZIALI O PUNITIVI, NÉ DI PERDITE DI PROFITTI, RICAVI, DATI O ESITI SANITARI DERIVANTI DA (A) USO O IMPOSSIBILITÀ D'USO DELL'APP; (B) AFFIDAMENTO SULL'ACCURATEZZA O COMPLETEZZA DEI DATI VISUALIZZATI DALL'APP; O (C) DECISIONI BASATE SU INFORMAZIONI OTTENUTE DALL'APP.
Accetti di manlevare, difendere e tenere indenne Totem e i suoi amministratori, dipendenti e agenti da qualsiasi reclamo, responsabilità, danno, perdita e spesa derivante o in qualsiasi modo connesso al tuo uso dell'App o alla violazione dei presenti Termini.
Totem può modificare i presenti Termini in qualsiasi momento. Le modifiche sostanziali saranno annunciate nell'App o su questa pagina, e la data "Ultimo aggiornamento" in cima al documento sarà aggiornata. L'uso continuato dell'App dopo tali modifiche costituisce accettazione dei Termini aggiornati.
Puoi interrompere l'uso dell'App in qualsiasi momento disinstallandola. Totem può sospendere o terminare il tuo accesso all'App in qualsiasi momento, con o senza preavviso, in caso di violazione dei presenti Termini. Alla cessazione, la licenza concessa nella Sezione 4 cessa immediatamente.
L'App può integrarsi con servizi di terzi (Apple Health, relay Nostr, Apple Watch, accessori cardio BLE). L'uso di tali servizi è soggetto ai termini e alle privacy policy dei rispettivi terzi. Totem non è responsabile dei servizi di terzi.
I presenti Termini sono stipulati unicamente tra te e Totem, non con Apple Inc. Apple non è responsabile dell'App né dei suoi contenuti. In caso di mancata conformità dell'App a garanzie applicabili, puoi notificarlo ad Apple, che rimborserà il prezzo d'acquisto dell'App, se applicabile. Nella misura massima consentita dalla legge, Apple non avrà altri obblighi di garanzia riguardo all'App. Apple e le sue controllate sono beneficiari terzi dei presenti Termini e, dopo la tua accettazione, avranno il diritto di farli valere nei tuoi confronti.
I presenti Termini sono disciplinati e interpretati in conformità alle leggi italiane, senza riguardo alle norme di conflitto di legge. Qualsiasi controversia derivante da o in connessione con i presenti Termini sarà sottoposta alla giurisdizione esclusiva dei tribunali italiani, fatte salve le norme inderogabili di tutela del consumatore.
